Nothing in these Terms limits rights that UK consumer law gives you and that cannot lawfully be excluded.

1. Who we are and how to contact us
1.1Kindi is operated by Kindi Learning Ltd, a company registered in England and Wales under company number 15989372. Our registered office is Suite 2, Unit 1b, Pope Iron Road, Worcester, Worcestershire, United Kingdom, WR1 3HB.
1.2Website: https://kindilearning.com.
1.3Customer support, cancellation and complaints: support@kindilearning.com.
2. Who these Terms apply to
2.1You must be at least 18 years old and acting as a consumer. The launch funnel and Founding Family offer are intended for parents and carers purchasing for personal or family use, not for resale or business use.
2.2By joining the waitlist or placing an order, you confirm that the information you provide is accurate and that you have authority to use the chosen email address and payment method.
2.3Separate privacy and cookie information explains how we use personal information and technologies on our website. Marketing consent is optional and is not required to join the waitlist, receive an ordered resource or receive essential service messages.
3. The waitlist and free checklist
3.1You may join the Kindi waitlist and receive the free ‘Is My Child’s Speech on Track?’ checklist without buying the Founding Family offer.
3.2Joining the waitlist records your interest. It does not guarantee a particular launch date, product feature, price, place, level of availability or eligibility for every future offer.
3.3We may send the checklist, waitlist confirmation and essential information about your place whether or not you choose optional marketing emails. You may leave the waitlist by contacting us.
4. The Founding Family offer
4.1The current Founding Family price is a one-off payment of £39.99. The total payable will be displayed before you submit payment.
4.2The £39.99 purchase provides: (a) immediate access to the digital ‘Will My Child Be Ready?’ School Readiness Parent Guide; and (b) Founding Family status. It also carries a complimentary promotional entitlement to the first three monthly Kindi membership periods when Kindi launches, subject to these Terms.
4.3The three Kindi months are complimentary: no part of the £39.99 is allocated as payment for those months. The offer is not an investment, loan, donation, share purchase or crowdfunding arrangement. Founding Family status gives no ownership, voting, profit-sharing or other rights in Kindi Learning Ltd.
4.4Founding Family opportunities to give feedback or help shape Kindi are invitations, not guaranteed governance or product-control rights. We decide what feedback to adopt.
4.5The Founding Family offer is limited to one purchase per customer or household unless we expressly agree otherwise. A returning waitlist member may submit details for another child and receive the checklist again, but an existing purchaser will be prevented from buying the same Founding Family offer again. Contact support@kindilearning.com if you believe the purchase record is incorrect.
5. Orders, payment and acceptance
5.1Payment is processed by Stripe. Your order is an offer to buy. We accept it when Stripe confirms successful payment and we send an order confirmation or provide access to the Parent Guide, whichever happens first.
5.2We may reject or cancel an order before acceptance if payment is not authorised, the offer is unavailable, the price or description contains an obvious error, or we reasonably suspect fraud or misuse. If we cancel after taking payment for one of these reasons, we will refund the amount taken.
5.3We will email confirmation of your order and the contractual information required by law, including the purchase, price, how the Parent Guide is supplied and the agreed automatic-renewal details. We will identify the version of these Terms you accepted and make an enduring copy available to download or save.
5.4We are not currently registered for VAT. If our tax position changes, the consumer price displayed before purchase will state the total payable, including any tax that must be included by law.
5.5We use order references and payment-event controls to prevent an accidental repeat order or a repeated payment notification from creating an additional charge, entitlement or delivery. If you believe you have been charged twice in error, contact support@kindilearning.com promptly so that we can investigate and refund any payment taken without a valid order.
6. Immediate digital delivery and cancellation rights
6.1The Parent Guide is digital content. At checkout, you will be asked separately to expressly request immediate supply and acknowledge that your 14-day right to cancel the digital-content purchase ends once supply begins. The request will be unticked by default and must be actively selected.
6.2We will not begin immediate supply unless that express request and acknowledgement have been given. Once access or delivery begins following that consent, you will normally lose the statutory right to cancel merely because you change your mind.
6.3This does not affect remedies the law gives you if the Parent Guide is faulty, misdescribed, not of satisfactory quality or not supplied with reasonable care and skill where that standard applies.
6.4If immediate-supply consent is not given, we may be unable to complete the Founding Family order through the current instant-delivery checkout.
7. Licence for the Parent Guide and free resources
7.1We grant you a personal, non-exclusive, non-transferable licence to download, store, view and print the Parent Guide and free resources for your own household’s non-commercial use.
7.2You must not sell, sublicense, publicly post, mass-share, commercially reproduce, remove ownership notices from, or use the materials to train an artificial-intelligence model without our written permission. Reasonable sharing within your household is allowed.
7.3All intellectual-property rights in Kindi, the Parent Guide, checklists, branding, content and service remain ours or our licensors’. Your purchase does not transfer those rights.
8. Kindi’s development, launch and the complimentary period
8.1Kindi remains in development. We plan to launch it, but no fixed launch date is promised. Any estimated season or date is an aim rather than a contractual deadline unless we expressly confirm otherwise in writing.
8.2Your three complimentary monthly membership periods will begin on the activation date stated in our launch email. The activation date will not be earlier than the date on which Kindi is made available to you and any required onboarding instructions are supplied.
8.3A launch later than you hoped or than an earlier estimate does not automatically entitle you to a refund of the £39.99 because the paid Parent Guide is supplied immediately and Founding Family status is recorded at purchase. This does not limit any statutory right, including a right arising from faulty or misdescribed digital content or a material misrepresentation of the overall offer.
8.4If our launch plans change materially, we will contact Founding Families and explain the effect on the complimentary benefit and any options or rights that apply. We do not exclude any remedy that the law requires.
8.5Unless we say otherwise, the three included periods are consecutive and cannot be exchanged for cash, transferred, paused or combined with another free-period promotion.
9. Saving a payment method and agreeing to future billing
9.1Payment is processed by Stripe. Stripe may securely save your payment method for later use. Kindi does not receive or store your complete card number. Stripe processes payment information under its own terms and privacy information.
9.2Before continuing to checkout, you must actively select an unticked agreement confirming that you authorise Kindi to save your payment method and use it to charge you £29.99 per month after your three complimentary Kindi months from launch. The agreement also makes clear that the membership continues automatically until cancelled.
9.3Selecting that agreement authorises the future recurring payments described above. The separate £39.99 Founding Family payment will be clearly displayed and authorised when you complete payment through Stripe.
9.4We will record the wording and version of the agreement, the Terms version, the date and time it was accepted, and the customer and order to which it relates. These records are held in Kindi’s operational database and payment records as described in our Privacy Policy.
9.5You may cancel automatic renewal at any time. Cancelling automatic renewal does not remove your access to the Parent Guide, your Founding Family status or your three complimentary Kindi months. If you cancel before your first paid renewal becomes due, you will not be charged the £29.99 monthly membership fee.
9.6If the intended ongoing price rises above £29.99 per month before your first paid charge, or the membership changes materially from what was described when you agreed, we will explain the change and obtain fresh agreement before charging the new amount.
10. Launch and first-payment notices
10.1Before the complimentary period begins, we will email the address linked to your order with the activation date, onboarding or access instructions, the date the complimentary period ends, the intended first paid renewal date, the £29.99 monthly price and instructions for cancelling automatic renewal.
10.2We will send a reminder at least seven days before the first £29.99 charge. The reminder will clearly state the amount, the intended payment date and how to cancel before payment.
10.3If an important launch or payment email is returned as undeliverable, we will take reasonable steps using the contact information available to us. You are responsible for keeping your email address up to date and checking messages, including spam or junk folders.
10.4We will also provide any additional reminder, cooling-off or information notices required by the law applying at the relevant time.
11. Paid membership and renewal
11.1After the three complimentary months, your membership will automatically continue at £29.99 per month until cancelled, in accordance with the agreement described in clause 9.
11.2Each payment covers the next monthly membership period. We will charge the saved payment method on the renewal date stated in the notice sent to you.
11.3If a payment fails, we may retry it, ask you to update your payment method or suspend paid access after giving reasonable notice. We will not charge a fee merely because a payment has failed unless that fee was disclosed in advance and is lawful.
11.4We will provide any renewal reminders, cancellation methods, cooling-off rights or other protections required by the law applying at the relevant time.
12. Cancelling the membership
12.1You may cancel automatic renewal at any time by emailing support@kindilearning.com. We ask you to email us at least three calendar days before your renewal date where possible, to allow time for manual processing.
12.2Your cancellation takes effect when we receive your request. If we receive it before a renewal payment becomes due, you will not be liable for that renewal payment. If, because of a processing delay, the payment is nevertheless taken, we will refund it.
12.3If we receive your request after a renewal payment has already become due, cancellation will normally prevent the following monthly renewal. Your access will continue until the end of the current paid period unless the law requires otherwise.
12.4We will confirm your cancellation by email. Once automatic renewal has been cancelled, we will not reactivate it unless you actively agree to do so.
12.5You may also use any online cancellation method we make available. We will provide a straightforward online cancellation route where required by law and will explain how to use it in the relevant customer communications.
13. Refunds
13.1If you cancel automatic renewal before your first paid month becomes due, you will not be charged the monthly membership fee.
13.2Subject to any statutory cooling-off right that applies, monthly payments already taken are normally non-refundable once the relevant membership period has begun. Refunds will still be provided where the service is faulty, unavailable beyond a reasonable interruption, misdescribed, or the law otherwise requires one.
13.3Where the law gives you a cooling-off period following a renewal, we will honour that right and provide any full or proportionate refund required by law.
13.4The £39.99 Founding Family payment is governed by the digital-content provisions in clause 6 and the launch provisions in clause 8. Nothing in these Terms removes or restricts any statutory remedy available to you.
14. The Kindi service
14.1Kindi is intended to provide general early-years educational information, play ideas and parent guidance. It is not medical, diagnostic, therapeutic, clinical, speech-and-language, legal or safeguarding advice and does not replace a qualified professional.
14.2Children develop differently. We do not promise a particular developmental, speech, learning, behaviour or school-readiness outcome. If you are concerned about a child, seek advice from an appropriate professional, such as a GP, health visitor, speech and language therapist, nursery or school. For immediate danger or safeguarding concerns, contact the appropriate emergency or safeguarding service.
14.3An adult remains responsible for supervising activities, checking that materials and environments are safe and suitable for the child, and adapting activities for age, ability, allergies, disabilities and individual needs.
15. Availability and changes
15.1We aim to provide a reliable service but do not promise uninterrupted or error-free access. Maintenance, security events, supplier failures, internet outages or circumstances outside our reasonable control may cause interruptions.
15.2We may make reasonable changes to content, features or technical delivery to improve Kindi, reflect user needs, maintain security or comply with law. We will give reasonable notice where a change materially disadvantages an active paid member.
15.3If paid digital services are not supplied as required by law, your statutory remedies remain available. Nothing in this clause permits us to make the service materially different from its description without an appropriate remedy or fresh agreement where required.
16. Acceptable use
16.1You must use Kindi lawfully and only for personal or household purposes. You must not interfere with security, attempt unauthorised access, introduce malicious code, scrape or systematically copy content, impersonate another person, misuse community features, or use Kindi to harm or exploit a child or adult.
16.2If community or sharing features are introduced, additional rules may apply. We may remove unlawful or harmful material and take proportionate action to protect users and the service.
17. Suspension and ending access
17.1We may suspend or end access if you materially breach these Terms, misuse the service, fail to pay after reasonable notice, or create a security, legal or safeguarding risk. Where appropriate, we will explain the reason and give you a reasonable opportunity to put matters right.
17.2You may stop using the service at any time. Ending membership does not affect rights and obligations that arose beforehand, and clauses intended to continue—such as intellectual-property, liability and governing-law provisions—remain effective.
17.3If we permanently withdraw a paid service during a period you have already paid for, we will provide the remedy required by law, which may include a proportionate refund.
18. Our responsibility to you
18.1We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. Loss is foreseeable if it was obvious or both parties knew it might happen when the contract was made.
18.2We supply Kindi for private use. We are not responsible for business losses, including loss of profit, revenue, business, opportunity or data arising from business use that these Terms do not permit.
18.3Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of legal rights relating to digital content and services.
20. Changes to these Terms
20.1The version identifier and effective date appear at the beginning of these Terms. We will retain a record of the version accepted with each relevant order or billing agreement.
20.2We may update these Terms for legal, security, operational or service reasons. Changes do not retrospectively remove rights relating to a completed purchase. We will give reasonable advance notice of material changes affecting an active membership and obtain fresh agreement where the law or the nature of the change requires it.
20.3When a new version replaces these Terms, previous versions will remain available from the Terms page so that customers can find the version that applied to their order or agreement.
21. Other legal terms
21.1We may transfer our rights and obligations to another organisation, but only if this does not reduce your rights. You may transfer your rights only with our written agreement, except where the law permits otherwise.
21.2This agreement is between you and Kindi Learning Ltd. No other person has a right to enforce it, except a lawful successor to either party.
21.3If a court finds part of these Terms unlawful or unenforceable, the remaining provisions will continue. A delay in enforcing a right does not waive it.
21.4These Terms and any non-contractual dispute are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also use your local courts and retain any mandatory local consumer protections.
22. Complaints and contact
22.1Please send questions, cancellation requests or complaints to support@kindilearning.com. Include the email used for the order and enough information for us to identify it. Do not send full card details by email.
22.2We will acknowledge complaints and aim to respond within a reasonable time. This does not prevent you from using any statutory remedy or dispute route available to you.
